Ask Abilitix™ Pilot Terms of Use

1. Acceptance of Terms

By accessing or using the Ask Abilitix™ platform (the “Service”) as a pilot user, you agree to these Pilot Terms of Use
(the “Terms”). Abilitix Consulting Pty Ltd (“Abilitix”, “we”, “us”) provides the Service. If you are participating on behalf
of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Scope and Purpose

This pilot provides access to the Service for internal evaluation, testing, and feedback purposes only. You must not use the
Service in production, for resale, commercial exploitation, or public benchmarking without Abilitix’s prior written consent.

Non-production use: The Service must not be connected to production systems, live customer workflows, or used to
make automated operational decisions.

3. User Responsibilities

  • You must provide accurate information when registering for or using the pilot.
  • You must maintain the security of your login credentials and any access methods enabled (including OAuth sign-in).
  • You must not upload unlawful, harmful, infringing, or malicious content.
  • You must ensure you have all rights and permissions required to upload any data, documents, or content.
  • You must not attempt to reverse engineer, circumvent security controls, probe for vulnerabilities, or misuse the Service.

4. Data, Privacy & Confidentiality

You retain all rights to your uploaded data. Abilitix will handle your data according to our
Privacy Policy. Abilitix will not disclose your data to third parties except as required to
provide the Service, comply with law, or protect Abilitix’s rights and systems. We may use vetted subprocessors to operate
the Service (for example, hosting and AI providers), subject to contractual confidentiality and security obligations.

Sensitive Data Warning: Unless explicitly agreed in a separate Data Processing Agreement (DPA), you agree not to
upload live production Personally Identifiable Information (PII), Protected Health Information (PHI), or highly sensitive
financial data during this pilot. Use redacted or synthetic data for testing wherever possible.

5. AI Governance & Data Usage

The Service may use AI models to generate outputs. Your inputs and uploaded documents are not used by Abilitix to train
foundational AI models for general public use (for example, models provided via enterprise AI vendors). We do not permit our
AI providers to use your data to train their public models. Your data remains isolated to your pilot workspace context and is
used only to provide and improve the Service for you.

AI outputs are probabilistic and may contain errors. You are solely responsible for reviewing and validating outputs before
relying on them, and for any decisions or actions taken based on outputs generated by the Service.

6. Beta Disclaimer

The Service is provided “as is” during the pilot. It may contain bugs, delays, interruptions, or incomplete features.
Metrics, reports, or analytics generated during the pilot are for evaluation purposes only and should not be relied upon as
the sole basis for any critical business decision.

7. Third-Party Services

The Service relies on third-party infrastructure and services (for example, cloud hosting, database providers, AI model
providers, analytics, and billing). While Abilitix selects providers with appropriate security standards, Abilitix is not
responsible for upstream outages or limitations. AI outputs may be incomplete or inaccurate; human review is required.

8. No Warranty & Limitation of Liability

To the maximum extent permitted by Australian Consumer Law (ACL), Abilitix provides no warranties regarding uptime,
uninterrupted availability, or accuracy during the pilot. Abilitix is not liable for any indirect, consequential, special,
exemplary, or punitive damages.

To the extent permitted by law, Abilitix’s aggregate liability arising out of or relating to the pilot or these Terms is
limited to the amount you paid for the pilot (if any) or AUD $100, whichever is greater.

9. Term and Termination

This pilot runs for the agreed evaluation period (typically 30–90 days unless otherwise agreed). Either party may terminate
pilot participation at any time by providing written notice. Abilitix may suspend access if we reasonably believe the Service
is being misused or poses a security risk.

Upon termination, you may request export or deletion of your data within 30 days, subject to legal retention obligations and
reasonable operational requirements.

10. Intellectual Property

All rights, title, and interest in and to the Service (including trademarks, software, documentation, and methodologies)
remain with Abilitix Consulting Pty Ltd. No license or transfer is granted except as required to access and use the Service
during the pilot in accordance with these Terms.

11. Governing Law

Unless otherwise agreed in writing, these Terms are governed by the laws of New South Wales, Australia, and the parties submit
to the non-exclusive jurisdiction of the courts of New South Wales.

12. Modifications

Abilitix may update these Terms from time to time. Continued use of the Service after an update indicates acceptance of the
revised Terms.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and
Abilitix regarding the pilot and supersede any prior discussions or agreements about the pilot.
